Terms and Conditions: Stand a chance to WIN 1 of 10 R5 000 Queenspark vouchers

  1. This promotional offer is organised by RCS Cards Proprietary Limited (“RCS”) (NCRCP38/FSP 44481) (the “Promoter).
  2. Participation in this promotional offer constitutes an agreement to abide by the rules herein and you further bind yourself to the extent lawfully permissible.
  3. Promotion period: The promotion commences on 18 November 2021 and will terminate at 23h59 on 31 December 2021 (“Promotional Period”), no entries will be accepted beyond this date.
  4. Prize Details: 1 of 10, R5 000 Queenspark Gift Cards to spend at Queenspark stores. The Promoter reserves the right to marginally increase or reduce the value of the credit voucher at its sole and absolute discretion (“Prize”).
  5. How to qualify: All customers must abide by the below points to qualify:
    1. Customers must either have a Queenspark Store Card or apply and be approved for a Queenspark Store Card in-store or online;
    2. Customers must be in good credit standing;
    3. Customers must be a natural person and aged 18 (eighteen) years or older and be a resident in South Africa; and
    4. Customers must spend a minimum of R750.00 (Seven Hundred and Fifty Rand) using the Queenspark Store Card during the Promotional Period in-store or online.
  6. All eligible participants who comply with the entry mechanism of this promotional offer will automatically be entered into the draw and stand a chance to win the Prize. There will be a total of 10 (ten) winners to this promotional offer, in which a total of 4 (four) winners will be chosen from existing Queenspark Store Card holders and a further 6 (six) winners will be chosen from newly approved online Queenspark Store Card holders. Winners will be selected at random from the list of approved applications. No person may win more than one Prize in this competition. The competition is valid for online applications.
  7. The ten winners are to be chosen by 21 January 2022 and will be selected from the list of approved applications submitted during the Promotional Period. This decision will be final and no further correspondence will be entered into.
  8. Individuals ineligible to participate in the promotion: RCS Group and Queenspark employees, partners, directors, members, agents and consultants of RCS, as well as their spouses, life partners, children, siblings, business partners and associates, will not be eligible to participate in this promotion. To the maximum extent permitted in law, RCS Group and Queenspark excludes liability for any defects in the Prize.
  9. Prize fulfilment: RCS will be responsible for ensuring all eligible customers receive their gift cards. Vouchers are not transferable and cannot be exchanged for cash or any other consideration. Vouchers may not be redeemed online.
  10. Promotional offer notification: The winners of the Prize will be notified by RCS via telephone or email using the contact details on the RCS database system recorded against the selected Queenspark Store Card number.
  11. Customer Undertaking: Customer agrees that her/his participation in the competition means that the customer understands that he/she will only be entered into the draw if the obligations contained in clause 5 are fulfilled.
  12. It is the customer’s responsibility to ensure that the personal contact details captured on the RCS database system are complete, accurate and up to date.
  13. If the winner fails to comply with any of these rules of the terms of acceptance of the prizes, or if they refuse to sign the Promoters’ winner declaration or the Promoters; winner’s prize acceptance form, this will be construed as a rejection of the Prize and then, without prejudice to any other remedy which the Promotor and its associates may have, the winner will be automatically disqualified and will forfeit the Prize.
  14. Disclaimer: RCS, Queenspark, its associated companies, agents and service providers/co-promoters involved in the promotional offer assumes no liability whatsoever for any direct or indirect loss, damage, death, personal injuries, defamation, and/or any other claims arising in connection with this promotional offer.
  15. System Failure: RCS will not be responsible for lost, delayed and/or misdirected electronic messages, internet or computer malfunctions, errors in transmission or any condition beyond control of RCS which may cause the entry into the promotion to be disrupted or corrupted.
  16. Cancellation: RCS reserves the right to, in its sole discretion, to cancel, extend or suspend this promotional offer. If so, and to the extent permitted by law, all entrants agree to waive any rights that they may have in terms of this promotional offer and acknowledge that they have no recourse in such event against RCS, its associated companies, employees, agents, partners, suppliers, sponsors and/or co-promoter.
  17. The participant understands and accepts that, during its engagement with Queenspark and RCS, Queenspark and RCS may collect and process personally identifiable information about the entrant to allow the entrant to enter the competition, or in relation to, the entrants engagement by Queenspark and RCS, including all documents and information required to be furnished by the entrant to Queenspark and RCS from time to time. Such processing of information will be in line with the provisions of the Protection of Personal Information Act (“POPI”).
  18. The competition Terms and Conditions are available for download on the Queenspark website as well in Queenspark stores.
  19. This promotional offer, these rules and any dispute arising thereto shall be interpreted and subject to South African law. The South African courts shall have exclusive jurisdiction to determine any disputes arising out of of the application of these rules and/or in respect of this promotional offer.
  20. By participating in the promotional offer, entrants agree to indemnify Queenspark and RCS Group and release and hold Queenspark and RCS Group harmless against any and all losses, damages (direct, indirect and consequential) rights, claims and actions of any kind in connection with this promotional offer or resulting from acceptance and participation in the promotional offer including, without limitation, breach of the warranties set out above, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy.
  21. This competition shall comply with, and will be subject to, any peremptory provisions of the Consumer Protection Act 68 of 2008 (“CPA”) and the regulations promulgated thereunder, which are deemed to be incorporated herein (“Peremptory Provisions”). In the event of any conflict between these rules and the Peremptory Provisions, the latter shall prevail.   22. Any provision of these rules or the competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceable without invalidating or rendering unenforceable the remaining provisions thereof.
