QUEENSPARK VIP COMPETITION TERMS & CONDITIONS

 

1. This competition is conducted by Queenspark Proprietary Limited (registration number: 2001/022975/07) (hereinafter referred to as “Queenspark”). The competition will be open for entry on 3 August and will close at 23h59 on 30 September 2023 (“Promotion Period”) and no entries will be accepted after this date.
2. One winner will be randomly selected by an independent person in accordance with all relevant regulatory requirements on/before 16 October 2023. This decision shall be final and no further correspondence will be entered into.
3. The Winner will be notified via email on 16 October 2023. Further contact with the Winner will be made via email and or telephone on 16 October 2023. Should Queenspark be unable to contact the Winners, Queenspark reserves the right to select alternative winners and in such circumstances, the first chosen Winner will have no recourse against Queenspark.
4. Participation by entrants in this competition constitutes an agreement to abide by the rules herein and you further bind yourself to the extent lawfully permissible.
5. Non-compliance with these rules shall render the Winner ineligible to participate in this competition and to receive the Prize. Such person hereby acknowledges that he/she/they will have no recourse or claim of any nature whatsoever against Queenspark and/or its subsidiaries and/or its holding companies (including the directors, employees, members, independent contractors, agents, consultants, sub-contractors and/or any other representatives of the said entities).
6. Prize Details:

By participating in this competition in accordance with these rules, entrants stand a chance to win the prize which consists of (one) Queenspark Gift Card to the value of R5,000 (five thousand rand) and (two) Queenspark Gift Cards to the value of R2,500 each (“Prize”). The Prize is exclusively for Prize Winner and is not transferable, not exchangeable and cannot be exchanged for its cash value.

7. This competition is open to all Queenspark customers who are natural persons who are aged 18 (eighteen) years or older, and who are reside in South Africa
8. All Queenspark customers who provide their valid VIP information between 3 August – 30 September 2023 at a Queenspark store, via Queenspark social media entry mechanisms, or via www.queenspark.com will gain automatic entry into the competition draw.
9. The Winner will collect the Prize at one of Queenspark’s stores within the Republic of South Africa and will be required to sign an acknowledgement of receipt of such Prize.
10. No persons who are directors, members, partners, employees or agents of, or consultants to, Queenspark, its marketing service provider(s) utilised in connection with this competition, any supplier of goods or services in connection with this competition, any other person who directly or
    indirectly controls, or is controlled by them, or any spouse, life partner, parent, child, brother, sister, or business partner of any of such persons, may enter the competition.
11. The Prize is non-refundable, non-exchangeable and cannot be redeemed for cash. To the maximum extent permitted in law, Queenspark excludes liability for any defects in the Prize.
12. In the event of a dispute in respect of any aspect of this competition, Queenspark’s decision is final and no correspondence will be entered into.
13. Where an entrant fails to provide his/her personal information within 24 (twenty-four) hours of it being requested by Queenspark, s/he shall be disqualified from this competition and automatically forfeits the Prize. In the event of disqualification of a winner, Queenspark, in its sole discretion, shall be entitled, to select another winner from amongst the competition entrants.
14. By entering the competition, you agree to receive communications (including for the purposes of direct marketing) and direct marketing material from Queenspark. It being recorded that should an entrant unsubscribe from any or all marketing communication during the Promotion Period all entries your into the competition will automatically be deemed invalid and unenforceable.
15. To the maximum extent permitted in law, Queenspark and its directors, officers, employees, contractors and agents shall not incur any liability to any person for any injury, claim, loss or damage of any nature whatsoever, whether direct, indirect, consequential or otherwise, as a result of entering into or arising from any cause whatsoever or howsoever arising from their participation in, this competition or the use of any prize won there under (any such Prize being utilized at the own risk of any Winner thereof).
16. Queenspark reserves the right to (to the maximum extent permitted in law) amend this competition, including the rules and, in the event of any unforeseen circumstances or factors, the Prize itself.
17. Queenspark may, before or after the Winner of the competition has been publicly announced, require that a Winner permit the use of their image and/or name in its marketing material and/or participate in its marketing activities (including endorsing, promoting and/or advertising the services of Queenspark or any of its holding companies) (“the Invitation”). The Winner has the right to decline the Invitation. Should the winner fail to decline the Invitation by telephone: Chantal Le Roux 021 460 9552, e-mail: cleroux@queenspark.com or in writing to: Chantal Le Roux, 263 Victoria Road, Salt River, Cape Town, 8000 within 2 (Two) days of being notified that he/she is a winner of the competition, then such winner shall be deemed to have accepted the Invitation and granted their permission and/or agreed to participate in the manner as aforesaid. Winners will not be entitled to any payment or other form of remuneration for participating in any of the aforesaid activities. All and any publicity materials (including those utilising the Winner’s name and/or image) will be the sole property of Queenspark.
18. If any act, omission, event or circumstance occurs which is not reasonably foreseeable or is beyond the reasonable control of Queenspark and which delays or prevents Queenspark from complying with these rules, Queenspark will not be liable for any failure to perform or delay in performing its obligations.
19. Queenspark collects and uses the personal information of entrants to allow them to enter the Competition and to determine winners for the competition. Queenspark may use the Winner’s name and/or images in marketing material, which may include publication of the Winner’s name and/or images on the website and the Queenspark social media pages, but the Winner will always be informed of this beforehand and will be given an opportunity to refuse to permit any use of his/her names and/or images.
20. This competition shall comply with and will be subject to, any peremptory provisions of the Consumer Protection Act 68 of 2008 (“CPA”) and the regulations promulgated thereunder, which are deemed to be incorporated herein (“Peremptory Provisions”). In the event of any conflict between these rules and the Peremptory Provisions, the latter shall prevail. 21. This competition, these rules and any dispute pursuant thereto shall be subject to and construed in accordance with South African law. The South African courts shall have exclusive jurisdiction to determine any disputes in respect of the application of these rules and otherwise in respect of this competition.
22. Any provision of these rules or the competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceable without invalidating or rendering unenforceable the remaining provisions thereof.
23. By participating in the competition, entrants agree to indemnify Queenspark, and release and hold Queenspark harmless against any and all losses, damages, rights, claims and actions of any kind in connection with this Competition or resulting from acceptance and participation in the Competition including, without limitation, breach of the warranties set out above, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy.
24. The entrant understands and accepts that, during its engagement with Queenspark, Queenspark may collect and process personally identifiable information about the entrant to allow the entrant to enter the competition, or in relation to, the entrant’s engagement by Queenspark, including all documents and information required to be furnished by the entrant to Queenspark from time to time in terms.
